On April 20th, the Swedish parliament voted and approved the government’s proposal for stricter labour immigration rules. The goal is to combat exploitation of labour migrants and attract and maintain international competence.
The proposal includes the following points:
- A new type of residence permit for certain categories of highly qualified and educated people, allowing entry to Sweden, for the purpose of finding employment.
- Administrative errors by employers should not result in permit rejections and/or deportations.
- Employment contract required to be submitted as an attachment to a work permit application.
- Changes to employment terms need to be reported to the Migration Agency.
- Employers may be required to declare employment conditions for employees with work permits.
- Maintenance requirement for family members introduced for first time applications and extensions.
- Work permits issued on the basis of false information may warrant the offence of human trafficking.
Our Recommendations
- Inform candidates and relocating employees of the maintenance requirement for family members, as this may affect their decision to relocate. We will provide details on the parameters of this requirements, as soon as they become available.
- Ensure employment contract is submitted along with a permit initiation sent through our portal.
- Employment history assessments may be needed for candidates with the new type of residence permit, to confirm work permit eligibility.
